1. Acceptance of our Terms
By visiting the website Trendus.co.za, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to Trendus.co.za, you agree to be bound by the following Terms and Conditions of Service. If you do not want to be bound by our Terms your only option is not to visit, view or otherwise use the services of Trendus.co.za. You understand, agree and acknowledge that these Terms constitute a legally binding agreement between you and Trendus.co.za and that your use of Trendus.co.za shall indicate your conclusive acceptance of this agreement.
2. Definitions and Interpretation
In this Agreement, unless the context otherwise requires, the following definitions shall apply:
"Agreement" means this agreement between Trendus.co.za and the Consumer or Retailer subject to the terms and conditions set out below.
"Business Day" means any day (other than Saturday or Sunday) on which clearing banks are open for business in South Africa.
"Consumer" means a Consumer in terms of the Consumer Protection Act 68 of 2008.
“The Consumer Protection Act” means the Consumer Protection Act 68 of 2008 (the “CPA”).
"The Protection of Personal Information Act of 2013" means the Protection of Personal Information Act of 2013 (the “POPI”).
“Personal Data” means all data supplied to Trendus.co.za by or on behalf of the Consumer or Retailer pursuant to this Agreement which is defined as personal data under the POPI Act.
“Privacy Policy” means the Privacy Policy available on Trendus.co.za website or Online Platform which the Consumer or Retailer assents to.
“Shopping Cart” means any and all goods selected by the Consumer or Retailer or User which once selected form part of the User’s order. The shopping cart serves merely as an online item placeholder for goods prior to the transaction being finalized. Trendus.co.za reserves the right to remove, modify or otherwise change the items available in the shopping cart at any time. Items in the shopping cart may be available for a limited period of 60mins only taking into consideration demand and availability of stock. Items are sold on a “first come first serve” basis and Trendus.co.za cannot guarantee the availability of items in the user’s shopping cart.
“Checking Out/Check Out” means any and all goods selected by the Consumer or Retailer which are then confirmed and accepted by the User in completion of the transaction.
“Contract” means the completion of an order and commencement of a legally binding agreement between Trendus.co.za and the Consumer or Retailer.
"Order" means a purchase completed or submitted by means of Trendus.co.za website or Online Platform.
“You/Your” means the Consumer, Retailer or User of Trendus.co.za website or Online Platform including both Consumers and Retailers.
“User” means any natural person who makes use of, transacts on, contracts with, or makes use of the Trendus.co.za website or Online Platform including both Consumers and Retailers.
"Website or Online Platform" means the Trendus.co.za website and Online Platform, including its Official Social Media Accounts, Mobile Websites and Mobile Applications.
Where the context permits, words denoting:
(a) persons shall include bodies corporate and unincorporated associations of persons;
(b) The singular includes the plural and vice versa; and
(c) one gender shall include any gender.
All headings are for ease of use and reference only and shall not affect the interpretation or construction of these terms and conditions in any way.
3. Provision of Services
You agree and acknowledge that Trendus.co.za is entitled to modify, improve or discontinue any of its services at its sole discretion and without notice to you even if it may result in you being prevented from accessing any information contained init. Furthermore, you agree and acknowledge that Trendus.co.za is entitled to provide services to you through subsidiaries or affiliated entities.
4. Proprietary Rights
You acknowledge and agree that Trendus.co.za may contain proprietary and confidential information including trademarks, service marks and patents protected by intellectual property laws and international intellectual property treaties. Trendus.co.za authorizes you to view only and NO copy of portions of its content for offline, personal, non-commercial use. Our content may not be sold, reproduced, or distributed without our written permission. Any third-party trademarks, service marks and logos are the property of their respective owners. Any further rights not specifically granted herein are reserved.
5. Submitted Content
When you submit content to Trendus.co.za you simultaneously grant Trendus.co.za an irrevocable, worldwide, royalty-free license to publish, display, modify, distribute and syndicate your content worldwide. You confirm and warrant that you have the required authority to grant the above license to Trendus.co.za.
6. Termination of Agreement
The Terms of this agreement will continue to apply in perpetuity until terminated by either party without notice at any time for any reason. Terms that are to continue in perpetuity shall be unaffected by the termination of this agreement.
7. Disclaimer of Warranties
You understand and agree that your use of Trendus.co.za is entirely at your own risk and that our services are provided “As Is” and “As Available”. Trendus.co.za does not make any express or implied warranties, endorsements or representations whatsoever as to the operation of the Trendus.co.za website, information, content, materials, or products. This shall include, but not be limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement, and warranties that access to or use of the service will be uninterrupted or error-free or that defects in the service will be corrected.
8. Limitation of Liability
You understand and agree that Trendus.co.za and any of its subsidiaries or affiliates shall in no event be liable for any direct, indirect, incidental, consequential, or exemplary damages. This shall include, but not be limited to damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information or other intangible loss arising out of the use of or the inability to use the service, or information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information. The above limitation shall apply whether or not Trendus.co.za has been advised of or should have been aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed the liability of Trendus.co.za is limited to the greatest extent permitted by law.
9. External Content
Trendus.co.za may include hyperlinks to third-party content, advertising or websites. You acknowledge and agree that Trendus.co.za is not responsible for and does not endorse any advertising, products or resources available from such resources or websites.
10. Jurisdiction
You expressly understand and agree to submit to the personal and exclusive jurisdiction of the courts of the country, state, province or territory determined solely by Trendus.co.za to resolve any legal matter arising from this agreement or related to your use of Trendus.co.za. If the court of law having jurisdiction, rules that any provision of the agreement is invalid, then that provision will be removed from the Terms and the remaining Terms will continue to be valid.
11. Exchange and Return Policy
Trendus.co.za will refund or exchange all goods if you return them within 7 days of purchase, provided that the goods must still be in their original condition and packaging and may not have been used.
You will also be required to present the original tax invoice that is sent to you via email or with the goods. The goods Trendus.co.za excludes from the 14-day exchange or refund policy are: unless there is a manufacturing defect in the goods, you can only return these goods if they are still in the original condition, sold and the packaging, if transparent, has not been opened yet; goods purchased by way of special arrangement or custom order will only be replaced if defective.
The delivery cost of items purchased will still be the responsibility of the customer, and Trendus.co.za will not refund delivery costs. Products received damaged or due to manufacturing defect: email complaint to be received back within 2 hours of receipt with clear picture reference of damages.
The return process will be initiated and the product will be re-collected, once received back to our Distribution Centre or the receiving centre will be evaluated and exchanged if necessary or refunded.
Trendus.co.za does not take responsibility for any Products damaged whilst in transit with couriers and delivered damaged to clients.
Changes to our returns page or refunds page shall be effective concerning all purchases made from the date of publication of the change on our website.
Gift vouchers, giveaways and discounts will not be refunded.
Refunds are not provided for payments under R500. Instead, a credit option is given.
Refunds are offered on payments exceeding R750.
12. Delivery Policy
The listed price of Items does not include delivery and the delivery cost will be displayed at checkout. Delivery time will take place between 3 to 7 working days. Delivery cost is not refundable in all circumstances. Goods are despatched in sealed packaging and should be received in the same manner.
Please ensure that when receiving delivery of your purchase, it is sealed.
Subject to these Terms, The Delivery Service Provider agrees to receive and arrange for the provision of the Service to the Consignee by the information on The Delivery Service Provider’s Waybill or return of the Shipment to the Customer (or its nominee) when the Shipment was not delivered to the Consignee.
Any instruction from the Customer to The Delivery Service Provider and/or a TPA to provide the Service shall be on The Delivery Service Provider Waybill, duly completed and tendered with the Shipment.
Unless otherwise agreed in writing and signed by The Delivery Service Provider, no other instructions, whether verbal or written shall be binding on The Delivery Service Provider or any TPA.
A Shipment under these Terms shall be deemed to have been received into The Delivery Service Provider or any TPA’s possession only upon –the Shipment being received into The Delivery Service Provider or the TPA’s physical possession; and receipt acknowledging acceptance being issued by The Delivery Service Provider or the TPA and furnished to the Customer by an expressly authorized The Delivery Service Provider and/or TPA Personnel. The Customer is responsible for ensuring that the person furnishing such receipt is expressly authorized to do so by The Delivery Service Provider or the TPA.
Delivery to the Consignee, or, on a Shipment returned to the Customer (or its nominee), shall be conclusively evidenced by a signed receipt being given therefore by the Consignee or the Customer.
A POD shall be conclusive proof that the Shipment was delivered by these Terms, in good order and condition, in an intact form, without any Loss and shall further constitute a final and absolute release of all undertakings, obligations and liabilities of The Delivery Service Provider and/or any TPA.
Goods will only be delivered once funds are paid in full and cleared.
13. Currency and Payment Policy
Trendus.co.za is a South African-based company and hence, items are sold in South African Rands (ZAR) and include 15% VAT.
There are three distinct methods of effecting payment for purchases rendered on this site. These are via Credit Card and Debit Card Through the Payfast Secure portal and Direct Funds Transfer.
Please note that, while all inquiries will be received by Trendus.co.za they will NOT BE PROCESSED until proof of payment has been received by Trendus.co.za to the email address info@trendus.co.za.
Credit Card and Refund Policy
Payment by credit card is immediately authorized by an online payment gateway, provided that all details are correctly captured. Trendus.co.za takes no responsibility for the fraudulent use of Internet Banking login codes and PINS. Note that once a conduct order has been captured, it is considered to be authorization to start the verification process by Trendus.co.za.
As such, there will be up to 14 days refund if the item is returned in the original way it was delivered.
Trendus.co.za shall be entitled to vary the price of any items without prior notice to the customer and at its sole discretion.
Whilst this is said every effort will be made to communicate any price changes before the time.
Trendus.co.za accepts direct deposits, EFTs, credit cards and debit cards.
14. Privacy Policy
Trendus.co.za demonstrates its commitment to our customer’s privacy by providing this statement. Trendus.co.za will do everything in our power to ensure your right to privacy. This website is governed by the laws of South Africa and Trendus.co.za chooses its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice or other documents or communication of whatsoever nature.
20. Changes to the Terms
Trendus.co.za reserves the right to modify these Terms from time to time at our sole discretion and without any notice. Changes to our Terms become effective on the date they are posted and your continued use of Trendus.co.za after any changes to Terms will signify your agreement to be bound by them.
